Mr.R.S.Selvam, learned counsel appearing for the first respondent submitted that the second respondent is no more.

2. We find that the second respondent is not a necessary party.

She was impleaded since the first respondent sought for pay on par with the second respondent. Hence, notice to the second respondent is deemed unnecessary.

3. Accepting the reasons assigned in the affidavit filed in support of the petition, this petition is ordered and the delay of 185 days in filing the above appeal is condoned.
