O R D E R
The petitioner has filed this petition to direct the respondents to consider petitioner's representation dated 05.07.2024 and to exclude petitioner property comprised in Survey number 376/6, measuring to an extent of acre 0.19 cents at Kolathur Village, Sriperumbudur Taluk, Kancheepuram Districtin 'Sujatha Nagar layout' of house sites in planning permission No.8681/LP-66.
2. The petitioner is the absolute owner and in possession of land measuring 0.19 acres in Survey No.376/6 at Kolathur Village, Sriperumbudur Taluk, Kancheepuram District, having purchased it through a registered sale deed dated 01.07.2021. Upon verification, the petitioner discovered that his property had been wrongly included as a "Park" in the Sujatha Nagar Layout under Planning Permission No.86-81/LP-66. Upon seeking clarification through an RTI dated 19.02.2021, the DTCP confirmed that only preliminary planning permission was issued by them, and the final approval was granted Page No.2 of 6
by the local body. Despite the petitioner submitting a representation on 05.07.2024 requesting exclusion of his land from the layout, no action has been taken by the respondents. Aggrieved by the inaction, the petitioner has filed the present writ petition seeking a direction to consider his representation and exclude his property from the planning layout.
3. Though many grounds have been raised in this writ petition, learned counsel for the petitioner would submit that it would suffice if this Court issues direction to the second respondent to consider the petitioner's representation dated 05.07.2024, within a time frame to be fixed by this Court.
4. Learned Government Advocate appearing for the second respondent has no objection for the said order being passed by this Court.
5. Heard the learned counsel on either side and perused the materials available on record.
6. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case directs the Page No.3 of 6
second respondent to consider the petitioner's representation dated 05.07.2024, after giving due notice to the petitioner, affording an opportunity of personal hearing and considering the documents filed by the petitioner and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
7. With the aforesaid observation and direction, this writ petition is disposed of. No costs.
