ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.310 of 2013 for the alleged offences under Sections 143, 188 of the I.P.C. r/w 7 (1) (A) CLA Act. The incident occurred on 05.05.2013. The allegation in this case is that accused were found to be catching conspiracy that they will attack the buses that are coming through the road and also burn them on 05.05.2013, on account of a political struggle. For the said allegation this case is pending as against A5. It is also suspected that A5 could have been died and the other accused are facing trial. The matter has been pending since 2013. There is no previous or subsequent case against the accused.

3.Considering the nature of the allegation, the antecedents of the accused and since there is no likelihood of any meaningful trial being conducted and no useful purpose would be served by keeping the matter pending. Page No.1 of 2 https://www.mhc.tn.gov.in/judis

4. Accordingly, the case in C.C.No.251/2024 of Judicial Magistrate Court No.II, Villupuram Taluk, Villupuram , stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
