ORDER
This Writ Petition is filed seeking a Writ of Mandamus directing the 2nd respondent to survey and demarcate the boundaries of the petitioner's property situated at Madhavaram Village, Madhavaram Taluk, comprised in Survey No.131/3, measuring an extent of 3.27 acres based on the petitioner's application dated 03.11.2023 within a stipulated time.
2. Heard and perused the materials available on record. 3.Though the learned Special Government Pleader appearing for the respondents submitted that the said property does not belong to the petitioner and therefore, survey cannot be conducted, so far, the respondents have not passed any order.
4. Therefore, having regard to the submissions made by the learned counsel on either side and since this writ petition is filed seeking a simple writ of mandamus to consider the petitioner's application, this Court without expressing any opinion with regard to the merits of the case, directs the respondents to consider the petitioner's application dated 03.11.2023 and 2/5
issue notice to the petitioner and the adjacent land owners of the four boundaries of the subject property and also to the rival claimants/interested parties/objectors if any, as the case may be and conduct enquiry in the manner known to law and pass orders on merits and in accordance with law within the time as stipulated in the circular No.R1/2005632/2022 dated 17.07.2023 issued by the Commissioner of Land Administration, from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
