This petition has been filed to modify the condition imposed by this Court in Crl.R.C.No.1410 of 2023 dated 31.08.2023 that the petitioner shall execute a bond for a sum of Rs.50,000/- before the trial Court. 2.This Court, by order dated 31.08.2023 in Crl.R.C.No.1410 of 2023 granted interim custody of the two wheeler, viz., Yamaha YZF R15 bearing Registration No.TN-07-CF-5043. One of the conditions was that petitioner to execute a bond for a sum of Rs.50,000/-.

3.The contention of the petitioner is that the order has been passed as early as on 31.08.2023. Since the Lower Court is insisting for property documents, the petitioner is unable to execute sureties and the vehicle is kept in open yard, exposing to vagaries of weather and the purpose of having interim custody is defeated.

rsi 4.Finding that the petitioner is only a college going student, the vehicle was purchased by his parents for the purpose of attending college and competitive exam classes, this Court is inclined to modify the condition. Accordingly, the order dated 31.08.2023 made in Crl.R.C.No.1410 of 2023 is modified to the effect that the petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees Five Thousand Only). All other conditions remain unaltered.
