The petitioners/A1 to A3 have filed Crl.OP.No.27685 of 2023 and the petitioners/A4 to A6 have filed Crl.OP.No.27686 of 2023, both in Cr.No.843 of 2023 registered by the respondent police for the offences punishable under Sections 294(b), 341, 323 and 506(i) of IPC , 1860 r/w Section 4 of the Prohibition of Harassment of Women Act, 2002.
2. It is the case of the prosecution that the defacto complainant, Social Activist had filed Writ Petition about encroachment of the petitioners herein in water bodies. Order had also been passed in the said writ petition. Therefore, the Revenue Authorities tried to enforce the said order. At that time, all the petitioners herein who are counsellors and Panchayat President had objected and created disturbance and also forced the defacto complainant to with draw the writ petition.
3. These activities of the petitioners are a direct challenge to the authority of law, wherein an order has been passed by the High Court directing removal and the petitioners cannot obstruct the enforcement of such order.
4. Taking all the facts into consideration, I am not inclined to grant anticipatory bail to the petitioners.
5. Accordingly, these Criminal Original Petitions are dismissed.
