The Petitioner/A2 who apprehends arrest at the hands of the Respondent Police for the offences punishable under Sections 7 and 20(1) of Cigarette and Other Tobacco Products Acts, 2003 read with Sections 273 and 328 IPC in Crime No.359 of 2023, seeks anticipatory bail.

2. It is stated that the Accused A1 had been taken into custody and had been released on bail.

3. It is the case of the prosecution that on 03.06.2023, the respondent had arrived at a restaurant, Rajasthan Dhaba and had arrested the Accused A1. He was found in possession of 840 Kgs of banned Tobacco products. It is also stated that 450 Kgs of banned Tobacco products were seized from a Mahindra Bolero car bearing Registration No.RJ-No-24-UA2269 and 390 Kgs of banned Tobacco products had been seized from a Toyota Innova car bearing Registration No.GJ-No-12-CG-6816. 1/3

4. The earlier application for anticipatory bail was dismissed on 20.10.2023 in Crl.O.P.No.24372 of 2023. It is however stated that the investigation will have to be done as to find out the source of the Tobacco products where the Petitioner had obtained.

5. There is no change in circumstances. At this stage, I am not inclined to grant anticipatory bail to the Petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
