(CRIME NO 58 /2023) .. Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus to direct the 6th respondent to entrust the file of the FIR No.58/2023 dated 16.02.2023 to the 5th respondent for conducting investigation within a stipulated time. ORDER
(Order of the court was made by the Hon'ble Chief Justice) Heard Mr.P.Vijendran, learned counsel for the petitioner; Mr.T.K.Saravanan, learned Government Advocate for the first respondent; and Mr.R.Muniyapparaj, learned Additional Public Prosecutor, assisted by Mr.Sylvester John, learned counsel for respondents 2 to 6.
2. On the last date, we had recorded the statement of learned Additional Public Prosecutor that the case has been transferred to the Crime Branch-CID and now, the crime number is registered, bearing transfer proceedings in RC.No.5541/Crime 4(2)/2023, and three persons are arrested and the arms are also acquired. A submission was made that as per the provisions of the statute, the information has to be given to the Central Bureau of Investigation. The matter was adjourned to enable the learned Additional Public Prosecutor to take instructions.
3. Today, learned Additional Pubic Prosecutor has placed on record a communication dated 21.3.2024 to the effect that the crime has been reported to the Central Bureau of Investigation.
4. As the crime has been reported, though belatedly, to the Central Bureau of Investigation, the purpose of the writ petition now stands served.
In view of the above, the writ petition is disposed of. There shall be no order as to costs.
