ORDER

The petitioner, apprehends arrest for the alleged offences under Sections 4(1)(C), 4(1-A) (ii) of Tamil Nadu Proibition (Amendment) Act, in Crime No.34 of 2025, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on the basis of secret information, the respondent police conducted a search in Pattivalavu Village. During the search, the petitioner was found to be in illegal possession of 6 litres of arrack and 80 litres of wash. Thereafter, the respondent police lodged the FIR against the petitioner on 28.06.2025. Accordingly, the respondent police registered the case in Crime No.34 of 2025 for offences under Sections 4(1)(C), 4(1-A) (ii) of Tamil Nadu Proibition (Amendment) Act.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that there is no previous cases pending against the petitioner and the coaccused already enlarged on bail. Hence, he prays for grant of anticipatory bail

to the petitioner.

4.The learned Government Advocate (Criminal Side) would submit that there are totally two accused and the petitioner is arrayed as A2 in this case. He would submit that the petitioner along with other accused persons were found in illegal possession of 6 liters of Arrack and 80 liters of wash. He would also submit that there is no previous case pending as against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 6.Taking into consideration the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
