ORDER
This Criminal Original Petition has been filed to direct the Inspector of Police (L&O) Madipakkam not to harass the petitioner pursuant to complaint made by G.Shanmugasundaram.
2. The learned counsel for the petitioner has submitted that due to property dispute, the petitioner herein has filed a suit in O.S.No.953 of 2014 and suppressing the said fact, one Shanmuga Sundaram has lodged a false complaint against the petitioner herein and based on the same, an F.I.R was registered in Crime No.1740 of 2016 under Sections 448, 294b, 341, 506(2) and in that case, the petitioner has got anticipatory bail in Crl.OP.No.16797 of 2016 dated 25.10.2016. He further submitted that subsequent to the same, Shanmuga Sundaram has lodged another complaint before the respondent police. Considering the aforesaid submissions, the respondent is directed to peruse the complaint and if the said complaint discloses any cognizable offence, he has to register an F.I.R and proceed further and in case, the said complaint does not disclose any cognizable offence, he can direct the complainant to produce materials to substantiate his case and thereafter, if the respondent is satisfied that the cognizable offence is made out, he can register a case and proceed in accordance with law, instead of that the respondent should not unnecessarily harass the petitioner.
4. With the aforesaid directions, this Criminal Original Petition is disposed of.
