A.No.6474 of 2023 and C.S.(Comm. Div.)No.56 of 2023 ABDUL QUDDHOSE.J., This application has been filed by the defendant raising a contention that the suit filed by the plaintiff is not a commercial dispute coming within the purview of section 2(1)(c) of the Commercial Courts Act, 2015. The said contention has been raised on the ground that since it is a buyer-seller relationship, the question of the dispute being a commercial dispute will not arise. However, the same is disputed by the learned counsel for the respondent/plaintiff. The learned counsel for the applicant / defendant is also agreeable for the issue that has been raised in this application to be adjudicated after trial.

2. In view of the submissions made by the learned counsel for the applicant/defendant, this application is disposed of by granting liberty to the applicant/defendant to raise all the contentions that have been raised in this application in the main suit.
