ORDER
This Criminal Revision Case has been filed to set aside the order dated 27.08.2024 made in Crl.A.No.4 of 2024 on the file of the learned Principal District and Sessions Judge, KAncheepuram In C.C.No.424 of 2014 for the offences under section 294(b),447,427,506(ii) of IPC on the file of the JM Court, Tambaram in and to allow the above Criminal Revision Petition.
2. The learned counsel for the petitioner submits that the husband of the petitioner filed Crl.A. No. 4 of 2024 on the file of the learned Principal District and Sessions Judge, Kancheepuram. While pending proceedings, the petitioner's husband died, as legal heir the petitioner inclined to proceed with the appeal but the said appeal was dismissed as not maintainable. Aggrieved over the same, the petitioner filed this Criminal Revision Case.
3. The learned Government Advocate (Crl. Side) submits that as per Section 413 of BNSS the victim can prefer appeal.
4. Heard the submission of the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).
5. In the case in hand, the wife of the victim preferred criminal appeal as a legal heir of the deceased victim she is entitled to proceed with the appeal. But the Court below erroneously dismissed Crl.A No. 4 of 2024 as such is liable to be set aside. The Principal District and Sessions Court, Kancheepuram, is directed to substitute the petitioner in the place of the deceased Mathiyalagan and proceed with appeal as per manner known to law. Accordingly, this Criminal Revision Case is disposed of.
