O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 121(1) and 109 of BNS, 2023 in Crime No. 156 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that on 10.06.2025, the petitioner along with other accused blocked the school bus, burst firecrackers and causing the glass windows to shatter, in which, some school children had severely injured. When the respondent police intervened to enquire, they were assaulted by the petitioner and others with stone, resulted in causing injuries to the policemen. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that one previous case is pending against the petitioner. He further submits that the petitioner is arrayed as A2. He further submits that investigation is not yet 2/6

completed. However, he opposed for grant of anticipatory bail to the petitioner.

5. Taking into the fact that the gravity of the offence committed by the petitioner and one previous case is pending against the petitioner and investigation is not yet completed and therefore, this Court is not inclined to allow this Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. 17.09.2025 MSM To 1.The Judicial Magistrate, Uthangarai.
