PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the authorities to forthwith consider and dispose of the petitioner's representation dated 22.07.2025, regarding his Voluntary Retirement Scheme (VRS) application, by initiating and completing all consequential proceedings and issuing the Voluntary Quit Service Certificate and other connected documents. ORDER
This Writ Petition is filed for issuance of a writ of mandamus, directing the respondents to forthwith consider and dispose of the petitioner's representation dated 22.07.2025, regarding his Voluntary Retirement Scheme (VRS) application, by initiating and completing all consequential proceedings and issuing the Voluntary Quit Service Certificate and other connected documents.
2. The case of the petitioner is that he was duly enrolled as Constable (General Duty) in Central Reserve Police Force in the year 2004 upon satisfying all conditions of eligibility prescribed under the recruitment
rules. He has rendered 21 years of continuous and unblemished service in various Battalions and Group Centres of the Force, including the tenure in operationally sensitive regions, such as Jammu & Kashmir and Assam. On 29.12.2024, while serving in 166 Battalion CRPF, he submitted a formal application seeking voluntary retirement, having completed the qualifying service of over 20 years, as required under the service regulations. Further, subsequent to his transfer to Group Centre, Avadi, Chennai, he was orally assured by the authorities concerned that his application for voluntary retirement together with issuance of Voluntary Quit Service Certificate would be duly processed without delay. Since his application, dated 29.12.2024, has not been considered, he has approached this court by way of this writ petition.

When the matter is taken up for hearing today, learned counsel for the respondents submitted that the petitioner applied for Voluntary Retirement Scheme through his application dated 29.12.2024, however, it has come to light that he joined Central Reserve Police Force by furnishing fake educational certificates and therefore an inquiry has been initiated and disciplinary proceedings are pending against the petitioner. In view of the same, till the disciplinary proceedings are over, the petitioner's request for voluntary retirement cannot be considered and, thereby, the writ petition is not maintainable.
4. Taking into consideration the fact that disciplinary proceedings
are pending against the petitioner in respect of furnishing of fake certificates at the time of joining service, the request of the petitioner for voluntary retirement cannot be considered and thereby the respondents have not passed any orders on the application of the petitioner. Accordingly, this Writ Petition lacks merit and is dismissed. It is made clear that this Court has not made any observation with regard to the disciplinary proceedings pending against the petitioner. No costs.
