O R D E R

This Writ Petition has been filed seeking a direction to the respondent to consider the representation of the petitioner dated 17.09.1999 made in respect of alteration of her date of birth in accordance with law and on its merits and pass orders within the time frame stipulated.

2. The learned counsel for the petitioner would submit that the petitioner joined the services of the respondent on a temporary basis in the year 1991 and her service was regularized on 03.05.1996. The actual date of birth of the petitioner is 17.10.1966 whereas a wrong entry has been made in the service register and hence, the petitioner had given a representation dated 17.09.1999 seeking to alter her date of birth from 01.11.1965 to 17.06.1966 in her service register. However, the same has not been considered by the respondent till date. Hence, this Writ Petition.

Per contra, the learned counsel for the respondent would submit that, as per Section 59(3) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, any application seeking alteration of date of birth received after five years of entering into service or any such application which is not supported by relevant material documents shall be 2/5

summarily rejected. He would further submit that the petitioner has given the application belatedly and the same has not been supported by relevant material documents and hence, it has been summarily rejected.

4. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the records.

5. A perusal of the records would clearly indicate that the application for change in date of birth has been made by the petitioner after five years of entry into service and that too, without any relevant material documents.

6. Therefore, this Writ Petition is devoid of merits and is accordingly dismissed. No costs.
