ORDER

This writ petition has been filed seeking a direction to the respondents 1 to 5, to disburse the family pension, Death Cum Retirement Gratuity (D.C.R.G ) and other service benefits to the petitioner (wife) and the other

legal heirs of Late.Raja Mohamed, who died on 09.01.2025, while serving working as a Food Safety Officer in Sholavaram Block, Thiruvallur District, by considering the petitioner's representations dated 22.04.2025, 18.07.2025, 22.07.2025 within a stipulated period to be fixed by this Court. 2.The learned counsel for the petitioner would submit that the petitioner's husband, Raja Mohamed, was appointed as a Sanitary Inspector in the office of the 3rd respondent in the year 1998. Subsequently, the Government of Tamil Nadu formed a new department, namely, Tamil Nadu Food Safety and Drug Administration Department to implement the Food Safety and Standard Act in Tamil Nadu State through G.O (Ms) No.347, Health and Family Welfare (AB2) Department dated 22.12.2011. Thereafter, the 5th respondent, vide proceedings dated 09.05.

2014, appointed the petitioner's husband as a Food Safety Officer in the said department with effect from 29.09.2011, and his time scale of pay was also fixed. Subsequently, on 02.07.2018, he was transferred from the 5th respondent office to the 4th respondent department i.e Sholavaram Block, Thiruvallur District, under the same designation of Food Safety Officer. Subsequent to the establishment of the said department on 24.09.2018 through G.O (Ms) No.438 dated 24.09.2018, adhoc rules were framed by the 1st respondent herein. Unfortunately, on 09.01.2025, the petitioner's husband died due to heart attack, leaving behind the petitioner and his other legal heirs.

grievance of the petitioner is that the terminal benefits of her deceased husband have not been settled in favour of the petitioner and the other legal heirs. Therefore, she made repeated representations on 22.04.2025, 18.07.2025 and 22.07.2025, however, no order has been passed till date. Hence, the present writ petition has been filed.

3.In view of the above, there shall be a direction to the 2nd respondent to settle the terminal benefits of the petitioner's deceased husband in favour of the petitioner and the other legal heirs, within a period of six (6) weeks from the date of receipt of a copy of this order, if not already settled and if there is no legal impediment.

4.With the above direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 10-02-2026 Index: Yes/No Speaking/Non-speaking order UMA
