ORDER
The petitioner has filed this writ petition seeking for issuance of a Writ of Mandamus to direct the respondents to consider her representation dated 21.08.2025 and permit her to visit India through Tourist visa to collect petitioner's Children's school Certificates from the Private Schools, Chennai. 2.The case of the petitioner is that she is the permanent resident and citizen of Srilanka. On 07.08.2018, through Tourist visa, the petitioner and her husband and children visited India, where the children studied in various 2/6
private schools. While so, the petitioner's children were sent out of India, where they were unable to get admission from any schools and their school records were retained by the school authorities. Now, it is essential to get admission in the Sri Lankan School and to proceed with the school education. Therefore, the petitioner is before this Court seeking the above prayer.
3.Learned counsel for the petitioner would submit that since the petitioner and her family members overstayed after the expiry of visa period, the petitioner and her family members were given EXIT cum leave India notice dated 07.03.2025 by the Foreigners Regional Registration Officers, Chennai and Civil Authority. In the said notice, the first respondent herein had directed the petitioner and her family members to exit leave India on or before 22.03.2025 and thereafter, the petitioner and her family members were sent to Sri Lanka. Therefore, the learned counsel for the petitioner prays for appropriate orders.
4.Mr.K.S.Jeya Ganesh, learned Standing Counsel accepts notice on behalf of respondents 1 and 2. Mr.P.Ganesan, learned Additional Government Pleader accepts notice on behalf of the third respondent. 3/6
Mr.S.Balaji, learned Government Advocate (Crl.Side) accepts notice on behalf of the fourth respondent. Learned Standing Counsel appearing for the respondents 1 and 2 submits that if the petitioner sends an email to the first respondent requesting for issuance of the school certificates from the respective school authorities and on receipt of the said email, the first respondent, shall collect the school certificates from the school authorities and send the same to the petitioner within a time frame fixed by this Court. 5.
Considering the request made by the learned counsel for the petitioner and the submission made by the learned Standing Counsel for the respondents 1 and 2, this Court, without going into the merits of the case, directs the petitioner to send an email to the first respondent requesting for issuance of school certificates from the school authorities concerned, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said email from the petitioner, the first respondent shall collect the school certificates from the concerned school authorities and send the same to the petitioner, by following the due procedure established under law, within a period of six weeks thereafter.
