Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, Directing the 3rd respondnet to 1/6

cancel the patta in the name of the representationd 5 to 8 in respect of the properties in survey Nos. 25, 29 and 161 which is sub divided as 161/1, 161/2, 161/3, 161/4 and 161/5 to an total extent of 4 Acres 30 cents by considering the petitioners representation dated 07.01.2025 within the stipulated period fixed by this honble Court For Petitioner : Mr.C.Samivel For Respondent : Mr.P.Ganesan, GA for R1 to R4

ORDER

This writ petition has been filed to direct the 3rd respondent to cancel the patta in the name of the respondents 5 to 8 in respect of the properties by considering the petitioner's representation dated 07.01.2025.

2. Mr.P.Ganesan, learned Government Advocate, takes notice on behalf of the respondents 1 to 4.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

4. The learned counsel for the petitioner would submit that in this case, the subject properties were originally purchased by the petitioner's grandmother vide sale deed dated 20.10.1933. Thereafter, she died on 19.08.1980. After the demise of petitioner's grandmother, the said properties were inherited by the petitioner's mother, who was also expired on 16.12.2002. Subsequently, the said properties were inherited by the petitioner and his 4 siblings, out of which, 3 sisters were died and hence, now, only the petitioner and his brother are the legal heirs and have right over the subject properties. Therefore, a representation was submitted before the respondents on 07.01.2025, requesting them to cancel the patta issued in the name of private respondents herein. However, the said representation was not at all considered by the respondents till date. Hence, this writ petition.

5. In reply, the learned Government Advocate appearing for the respondents would request this Court to pass appropriate orders directing the respondents to consider and dispose of the representation filed by the petitioner.

6. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents and also perused the materials available on record.

8. In view of the above, this Court directs the respondents to consider the petitioner's representation dated 07.01.2025 and dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of copy of this order.

9. With the above directions, this writ petition is disposed of. No costs.
