ORDER
Challenging the Order passed by the trial Court in I.A.No.359 of 2021 in HMOP.No.1045 of 2021, the present Civil Revision Petition has been filed by the petitioner.
2. The petitioner/husband had filed the Original Petition in HMOP.No.1045 of 2021 to dissolve the marriage of the petitioner and the respondent performed on 06.02.2014 on the ground of cruelty and desertion. During the pendency of the Original Petition, the respondent/wife filed an application claiming interim maintenance of a sum of Rs.30,000/- till disposal of the Original Petition. The trial Court considering the facts and circumstances of the case had directed the respondent to pay a sum of Rs.15,000/- as interim maintenance to the petitioner from the date of petition till the date of disposal of the main case. The respondent was also directed to pay the arrears of maintenance within two months and to pay the future maintenance on or before 5th every month. Aggrieved over the same, the present Civil Revision Petition has been filed by the petitioner/husband.
3. The learned counsel appearing for the petitioner would submit that he is only a driver by profession and he is only earning Rs.10,000/- per month and
the same is barely sufficient to meet his own basic needs and that the respondent/wife had deserted the matrimonial home on her own volition without any just cause and hence, prayed to set aside the Order of the trial Court.
4. Whereas, it is the contention of the learned counsel appearing for the respondent that the petitioner is having movable and immovable properties through which he is earning rental income and he is having sufficient source of income to pay the interim maintenance and hence, prayed to dismiss this revision.
5. The respondent had also produced the photographs of the properties of the revision petitioner. The petitioner has not filed any documents to disprove the same. Hence, this Court is not inclined to interfere with the Order of the trial Court.
6. Accordingly, this Civil Revision Petition is dismissed. No costs. Eight Weeks time is granted to the revision petitioner to pay the arrears of maintenance amount to the respondent and the petitioner shall pay the monthly maintenance amount as per the Order of the trial Court in I.A.No.359 of 2021 in HMOP.No.1045 of 2021 dated 21.11.2023. Consequently, connected miscellaneous petition is closed.
