O R D E R

The petitioner, who was arrested and remanded to judicial custody on 04.08.2025, for the offences punishable under Section 408 of IPC in Crime No.17 of 2025, on the file of the respondent Police, seeks bail.

The case of the prosecution is that the de facto complainant runs a construction company under the name and style of Bharathi Constructions and had authorized the petitioner to handle certain transactions on behalf of the company. Taking advantage of this authority, the petitioner allegedly diverted a sum of Rs.1,11,22,500/- from the company account to various other accounts and misappropriated the same. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the amount was transferred to various parties as per the instructions given by the de facto complainant. The petitioner is an innocent person and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of bail to the petitioner on the ground that the petitioner allegedly misappropriated a sum of Rs.1,11,22,500/-. The petitioner diverted funds from the company account to various accounts, including that of his wife. The respondent police have recovered a sum of Rs.33,22,500/-, and remaining amount of Rs.78,00,000/- is yet to be recovered. He further submitted that the investigation is still pending and steps are being taken to seize the balance amount.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the submissions of both parties and the gravity of the allegation that the petitioner misappropriated a substantial sum of Rs.1,11,22,500/-, and taking into fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner. K.RAJASEKAR, J.
