Degree course for the academic year 2024-2025 in the petitioner college as per the request made by the college by its representation dated 15.11.2024 and thereby direct the 1st respondent to open the online portal to upload the admitted students details of the college.

For Mr.R.Kannan - R2 COMMON ORDER Writ Petition in W.P.No.36042 of 2024 has been filed seeking issuance of a writ of mandamus, directing the 1st respondent /Tamil Nadu Teachers Education University, to remove the names of the 2nd and 3rd respondents and

replace them with the petitioner's name in the records, based on the petitioner's representation dated 17.11.2024.

Writ Petition in W.P.No.37403 of 2024 has been filed seeking a direction to the 1st respondent to grant approval for the students admitted to the B.Ed. degree course for the academic year 2024-2025 in the petitioner-college, as per the representation dated 15.11.2024. The petitioner also seeks a direction to the 1st respondent to open the online portal for uploading the admitted students' details.

3. The petitioner in W.P.No.36042 of 2024 will be referred as petitioners and the private respondents therein will be referred to as private respondents. There appears to be an inter-se dispute between the petitioners and the private respondents regarding the management and administration of the institution.

Learned counsel for the 1st respondent submits that the role of the University is limited to the grant of affiliation to the institutions and that the appropriate authority to resolve the inter-se dispute between the petitioner and the private respondent would be the Secretary, Higher Education Department,

Considering the inter-se dispute exists between the petitioner and the private respondent, and in the interest of the students, this Court, by an interim order dated 14.02.2025, directed the 1st respondent-University to open the online portal for uploading the student details for the academic year 20242025, on condition that the petitioner-college paid the eligibility and examination fees. The University was further directed to permit the students to appear for the first-year examination.

6. Since the issues involved in both writ petitions are common, with the consent of both parties, these writ petitions are taken up for final disposal and are disposed of by this common order.

Having regard to the nature of the dispute and in view of the submissions made, this Court is of the view that the Secretary to Government, Higher Education Department, Chennai, is the competent authority to decide the inter-se dispute between the petitioner and the private respondent, particularly as it relates to the administration of the institution. In the interest of the students, this Court suo motu impleads the Secretary, Higher Education Department, as the 4th respondent in W.P.No.36042 of 2024 and as the 3rd respondent in W.P.No.37403 of 2024.

Upon considering the facts and circumstances of the case, and without expressing any opinion on the merits of the rival claims, this Court directs the Secretary, Higher Education Department, to consider the representations submitted by the petitioners, dated 17.11.2024 (in W.P.No.36042 of 2024) and 15.11.2024 (in W.P.No.37403 of 2024), and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

9. With the above directions, both writ petitions are disposed of. There shall be no order as to costs. Regsitry shall make necessary amendments in the cause title and mark a copy of this order to the Secretary, Higher Education Department, Secretariat, Chennai.
