The petitioner, who was arrested and remanded to judicial custody on 13.06.2025, for the offences punishable under Sections 191(2), 193(3), 296(b), 115(2), 118(1), 351(3), 126(2), 309(4), 311 of BNS Act, 2023 Crime No. 185 of 2025, on the file of the respondent police, seeks bail. 1/4

2. The allegation against this petitioner is that petitioner joined hands with other accused had waylaid the de facto complainant and robbed a sum of Rs.3,350/- from him at knife point. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, however, he is suffering incarceration from 13.06.2025. He also submits that final report in this case is also not filed. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner 4.

The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that there are totally four accused in this case and the petitioner is arrayed as A2. He submits that there are two previous cases pending against this petitioner and the detention order against him is still in force. Hence, he opposed to grant bail to the petitioner. 2/4

Considering the facts and circumstances of the case, the allegations against the petitioner, submissions made by the learned counsels on either side, considering the fact that the petitioner is having 2 previous cases which are similar in nature, this Court is not inclined to grant bail to the petitioner.
