PRAYER To direct the respondents 1 to 3 herein to hand over the key of the premises bearing Door No.3/38, U.R. Nagar Extension, Anna Nagar West, 120 feet Road, Padi flyover, Chennai - 600 101, comprised in Survey Nos.75/2A of Padi Village, Ambattur Taluk, Thiruvallur District, within a time frame as fixed by this Honble Court.

ORDER

The petitioner seeks direction to the third respondent to handover the key of the subject premises.

2. From the records and affidavit, it appears that the petitioner let out the premises to one Nambirajan for running Water Packaging Unit. On inspection conducted by the Inspector of Food Safety Department, the premises was sealed. After sealing of the property, it appears that theft had occurred in the premises and FIR also registered in Crime No.36 of 2024. Thereafter, Food Safety Officer handed over the key to the Police. At this stage, the petitioner seeks direction to handover the key.

3. Meanwhile, it appears that the tenant Nambirajan also filed a suit in OS.No.144 of 2020 on the file of the District Munsif Court, Amabattur, which is pending. Be that as it may, once the petitioner allowed the tenant to come under his premises, though lease period has been over, it is for the petitioner to take appropriate action to vacate the tenant legally, not by way of filing a petition before this Court to get the key from the Police. Accordingly, this petition is dismissed.
