This application has been filed seeking to set aside the exparte order dated 09.11.0223 against the third respondent. The third respondent is the deceased brother's wife of the petitioner.

2. The Original Petition has been filed seeking Letters of Administration with respect to the Will executed by the father of the petitioners/father-in-law of the third respondent. Naturally the third respondent has a caveatable interest.

3. Taking all the factors into consideration and the fact that she is a necessary party, to provide an opportunity before any order is passed with respect to the Will, this application stands allowed. The exparte order dated 09.11.2023 is set aside.
