CMP.Nos.29549, 29548 and 29547 of 2023 in S.A.No.1179 of 2007 G.ARUL MURUGAN,J The first respondent in the appeal died.
2. The C.M.P.Nos. 29547, 29548 & 29549 of 2023 have been filed to condone the delay of 1946 days, seeking to set aside the abatement and to substitute the legal heirs.
3. This Court vide order dated 11.01.2024 issued notice to the proposed respondents.
4. Notice sent to the proposed respondents 6 to 8 in the petition / proposed respondents 8 to 10 in the appeal has been returned as refused.
5. Since the proposed respondents have refused to receive the notice it is deemed that the service is completed.
6. Perused the affidavit filed in support of the petition. Satisfied with the reasons, these Civil Miscellaneous petitions are ordered.
7. Registry is directed to carry out the necessary amendment and issue notice to the newly impleaded respondents 8 to 10 in the appeal. Notice to the respondents returnable by 18.03.2024. Private notice is also permitted.
8. Post the second appeal on 18.03.2024.
