PRAYER This writ petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus forbearing the respondents from unlawfully interfering or in any manner prohibiting or causing any disturbance in the peaceful functioning of the petitioner Recreation Centre Functioning at M/s.Shanumga Recreation Centre No.1, Nedumaran Street, Janaki Nagar, Valasaravakkam, Chennai-87.

ORDER

This writ of mandamus has been filed seeking a direction to forbear the respondents from unlawfully interfering with the peaceful functioning of the petitioner's Recreation Centre.

2. According to the petitioner, the Recreation Centre is registered under Section 16(3)(b) of Tamil Nadu Societies Registration Act. The object of the Centre is to encourage the cultural activities and provide recreational and sports 2/5

facilities for indoor and outdoor games. Now, the respondents 2 and 3 are interfering with the activities of the Centre and are forcing the petitioner to close the same.

Whereas the learned Government Advocate (crl.side) appearing for the respondents, on instructions, would submit that an FIR has been registered under Sections 45 and 46 of the City Police Act for gambling and hence, the petitioner is before this Court. It is further submitted that the respondents have not compelled the petitioner to close the Centre.

4. The relief sought by the petitioner to restrain the respondents from entering the premises cannot be granted. The police have every right to carry out necessary inspection if gambling or any other illegal activities are suspected within the premises. In such view of the matter, a blanket order of restraint cannot be granted.

5. Recording the submission of the learned Government Advocate (crl.side) that the respondents have not compelled the petitioner to close the centre, this Writ Petition (criminal) is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
