ORDER

This Writ Petition (Criminal) has been filed challenging the order dated 09.05.2025 passed by the first respondent, thereby rejecting the request made by the petitioner for the issuance of a No Objection Certificate to operate a Spa under the name and style of "Supreme Bali Spa". 2.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner is the proprietor of "Supreme Bali Spa" which is being running after obtaining requisite permissions from the Corporation and other authorities. The petitioner has entered into a lease agreement with the landlady of the premises to run the said spa. Subsequently, upon submission of all necessary documents, the petitioner also obtained a license from the Coimbatore City Municipal Corporation. Further, the petitioner applied for a license from the Tamil Nadu Rescue Services, Coimbatore District and the concerned Authority accordingly issued a license to the petitioner to run the spa. However, the second respondent has now rejected the request made by the petitioner for the issuance of No Objection Certificate to run the spa, that too, on the ground that the petitioner's premises contains seven rooms and consequently, lacks sufficient space for vehicle parking. 4.

That apart, the second respondent also assumed that there would be massage conducted at the premises by the female therapists for male clients.

Further, there has been no complaint as against the petitioner till date, and all the authorities concerned granted licenses only after inspecting the premises and verifying the necessary requirements. In fact, the Tamil Nadu Fire Rescue Services also issued a license to the petitioner to run the spa. It shows that on some other reason the second respondent refused to issue No Objection Certificate to run the spa.

In view of the above, the order passed by the first respondent cannot be sustained and is liable to be set aside. Accordingly, the order dated 09.05.2025 passed by the first respondent is hereby set aside. The second respondent is directed to issue No Objection Certificate to the petitioner within a period of two weeks from the date of receipt of a copy of this order. It is made clear that the petitioner under the guise of carrying on business activity shall not indulge in any unlawful or illegal activities detrimental to law and order or public order. It is further made clear that this order will not prohibit the respondents/authorities concerned from interfering in the petitioner's business activities, if there is any violation on the part of the petitioner. 6.

With the above directions, this Writ Petition (Criminal) stands allowed. Consequently, connected miscellaneous petition is closed. No costs. 15-06-2026 Internet : Yes/No LPP
