This Writ Petition has been filed to direct the respondent Nos.1 and 2 to permit the petitioner to operate its Current Account No.8441210000003292 maintained with the first respondent Bank, namely DBS Bank, Adyar Branch, Chennai.

2. The learned counsel appearing for the petitioner submits that the petitioner Company, namely, M/s.Start Connect Agri Technology Private Limited has been maintaining a current account with the first respondent Bank since 2024 and operating the account with utmost diligence and

complying with all applicable banking norms, regulations and guidelines issued by the Reserve Bank of India and other relevant authorities. The petitioner Company is having substantial balance of Rs.38,71,235.82/- in the said account. The entire business operation including payment of salary to its employee would be taken place through the said account only. While so, the second respondent requested the first respondent to freeze the bank account of the petitioner in connection with complaint/case No.31909240128458 dated 31.12.2024 for the alleged transaction of Rs.2,860.54/- to the petitioner's Bank account and the first respondent, without issuing any notice to the petitioner, de-freezed the petitioner's bank account. Hence, this Writ Petition has been filed. He would further submit that the petitioner has no objection to keep the alleged transaction amount of Rs.2,860.54/- in a separate account for the satisfaction of the second respondent's complaint and allow the petitioner to operate the bank account.

3. Inspite of issuance of notice, none appears for the respondents. Hence, based on the materials available on record, this Court is inclined to dispose of this writ petition.

Considering the fact that a substantial amount is available as balance in the current account of the petitioner and only a very paltry sum of Rs.2,860.54/- is due and payable on the second respondent's complaint, freezing the entire account and making the account un-operational would cause great prejudice to the petitioner which is a running business operation. In view of the fact that the petitioner has undertaken that the sum equivalent to the second respondent's complaint be kept in a separate account, the balance amount may be permitted to be operated by the petitioner on the basis of the stand taken by the petitioner.

Accordingly, this Writ Petition is allowed with a direction to the first respondent to de-freeze the bank account of the petitioner and keep a sum of Rs.2,860.54/- in the separate account and allow the petitioner to operate its current account. The petitioner is also directed to maintain a sum of Rs.5,000/- as balance amount in the aforesaid current account. There shall be no order as to costs.
