The petitioner, who apprehends arrest at the hands of the first respondent police for the alleged offences punishable under Sections 409 and 420 of IPC, in Crime No.263 of 2023, on the file of the first respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that there was a money dispute between the petitioner and the de-facto complainant. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false case has been foisted against him. He further submitted that the defacto complainant had earlier filed a suit in O.S.No.26192 of 2021 before the High Court of Bombay, which is still pending. While so, on the same set of facts, a complaint has been lodged before the first respondent police and leading to an apprehension of arrest. He would submit that the petitioner is ready to approach the jurisdictional Court in Maharastra and seek for anticipatory bail. 1/4

4. The learned Government Advocate (Crl.Side) submits that the petitioner was issued with a notice under Section 35(3) of BNSS Act on 25.11.2024 and he has appeared.

4. Taking into consideration, the facts and circumstances of the case, this Court is inclined to grant interstate interim anticipatory bail to the petitioner for a period of two weeks from today to enable him to move the concerned Court.

Accordingly, interim interstate anticipatory bail is granted on condition that the petitioner shall produce the sale deed within a period of two weeks from today before the XVII Metropolitan Magistrate, Saidapet, Chennai and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Thereafter, within a period of two weeks from the date of execution of bail bond, the petitioner shall approach the jurisdictional Court in Maharastra and apply for anticipatory bail. In the event of not complying 2/4

the time line in execution of sureties, the order of interstate anticipatory bail shall stand automatically cancelled.
