Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent herein to carry out the necessary correction of the Mother's name in the Birth Certificate of the petitioner's daughter based on the representation dated 28.08.2025 within a reasonable time.

O R D E R

This Writ Petition is filed seeking for a Mandamus to the 1st respondent herein to carry out a correction in the Birth Certificate of the petitioner's daughter based on her representation dated 28.08.2025.

2. The petitioner gave birth to a child on 28.03.2009. The same is recorded in the Register of Births and Deaths maintained by the first respondent. Instead of giving the name of the mother as ''Mariyayi'', it was wrongly entered as ''Mariammal''. Hence, the petitioner approached the first respondent by way of a representation seeking for correction of Page Nos.2/5

name in the Register maintained by them. As no action was forthcoming, the petitioner has come forward with this writ petition.

3. Heard Ms.B.N.Sinega, learned counsel for the petitioner and Mr.Nazeeb Usmankhan, learned Standing counsel for R1 and Ms.C.Meera Arumugham, learned Additional Government Pleader for R2 to R6.

4. The petitioner asserts that there is a mistake in the birth certificate issued to her daughter Subhasri. Subhasri is a minor and hence, the petitioner has filed the Writ Petition on her behalf. The name of the mother has been erroneously entered as aforesaid. Section 15 of Births and Deaths Act, 1969 gives power to the appropriate Registrar to correct the Register, in case there is an error. In this case, the authority, who maintains the records is the first respondent.

5. The learned counsel for the first respondent states that they will cause an enquiry and pass appropriate orders on the request of the petitioner within a period of four weeks. Prior to passing of any order, the first respondent shall hear the writ petitioner, as well as her daughter, Page Nos.3/5

if he so desires. The writ petition is ordered. There shall be no order as to costs.
