ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 18.02.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 28, 29 of NDPS Act, 1985 Amended and punishable under Sections 8(c) r/w 20(b)(ii)(C), 29, 29 of NDPS Act in F.No.48/1/05/2024NCB/MDS, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 04.07.2025 in Crl.O.P.No.7563 of 2025 on the following reasons:

"Considering the above facts and circumstances of the case, nature of allegations, taking note of the submissions made by the learned Special Public Prosecutor and considering the fact that co-accused in this case are absconding, this Court is not inclined to grant bail to the petitioner." 2.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 18.02.2024; that the co-accused / A1, A2 and A4 were already granted bail; that there is no progress in the Trial after filing of charge sheet; and that the petitioner is ready to abide by any condition that 2/4

may be imposed by this Court and sought for bail to the petitioner. 3.

The learned Special Public Prosecutor appearing for the respondent raised strong objection for grant of bail to the petitioner by stating that due to non-cooperation of the petitioner herein and the coaccused are evading service of notice and absconding, hence there is no progress in the trial after filing of charge sheet; that the co-accused/ A1, A2 and A4 were granted statutory bail and the petitions for cancellation of bail were also filed to cancel their bail.

Considering the submissions made on both sides, this Court dismissed the earlier bail application of the petitioner on merits and also considered the very same points raised by the learned counsel for the petitioner and since this bail petition is filed within short time after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.7563 of 2025 without any change of circumstances, once again revisiting the very same points is not permissible, hence this Court is not inclined to grant bail to the petitioner.
