Mrs.GLADYS DANIEL Mr.ANKUR SANGAL Mr. ABHISHEK.P COMMON ORDER The defendant has filed Memo dated 12.03.2025. The operative portion thereof is as under:- " The Defendant does not acknowledge any of the rights of the Plaintiff as set out in the subject plaint.

However, since the impugned advertisements as mentioned in Para 27 and Page 23 of the Plaint have already run it's course, the Defendant undertakes, in order to amicably resolve this matter, not to publish the said advertisements in future.

In view of the above, without prejudice to the rights and contentions of the parties, the suit may be disposed off recording the said undertaking."

2. Learned Senior Counsel for the plaintiffs submits that this undertaking is not acceptable to the plaintiffs. He therefore submits that he has been instructed to prosecute the suit and that the suit claim includes a claim for damages.

3. In view of the undertaking by the defendant not to publish the impugned advertisements in future, by recording such undertaking, OA Nos. 913, 914, 915 and 916 of 2024 are disposed of. 12-03-2025 1/2 2/4
