O R D E R

The petitioners herein, who were arrested on 30.07.2025 for the alleged offence punishable under Sections 61(2), 318(4), 340(2) of BNS, 2023 and Section 66D of the Information Technology Act, 2000 in Crime No.07 of 2025 on the file of the respondent, seeks bail. 2.The allegations against these petitioners are that the petitioners have contacted the defacto complainant through Whatsapp call and posed themselves as Delhi Cyber Crime Officials and threatened him as if a money laundering case is registered against him and persuaded the defacto complainant to transfer a sum of Rs.2,25,24,900/- to the fraudsters bank accounts and cheated him. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that the though the defacto complainant had made 12 separate transactions amounting to Rs.2,25,24,900/- to the alleged fraudsters, none of these transactions were credited or routed through the bank accounts of the petitioners. He further submitted that the petitioners are both illiterate persons and not having the knowledge or capacity to commit cyber crimes. Hence, he prays to grant bail to the petitioners. 2/5

4.The learned counsel appearing for the intervenor and the learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that only Rs.1,75,000/- was recovered and there are 8 previous cases pending against these petitioners across the country. Hence, they opposed to grant bail to the petitioners. 5.Heard both sides.

6.Considering the modus operandi and bad antecedents of the petitioners and also considering the fact that huge amount is yet to be recovered and there are 8 previous cases pending against the petitioners, this Court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected Criminal Miscellaneous Petition is closed.
