ORDER

Today, when the matter is taken up for hearing, there is no representation for the respondents. The respondents have not filed any counter affidavit.

2. This application is filed to condone the delay of 171 days in filing the written statement of D1 to D3.

3. Since there is no representation for the respondents, this Court, considering the reasons stated in the affidavit filed in support of the application, and as the applicants have engaged some other counsel and now the engaged counsel had entered into appearance, they wanted to peruse the signatures found in the plaint documents and in order to verify the defence taken in the written statement, it is clear that the delay had occurred.

4. Considering the number of days delay in filing written statement, this Court is inclined to allow the application. This application is allowed.

5. The written statement of D1 to D3 is taken on file.
