Petition seeking bail in respect of Crime No.1020 of 2024 registered for the offences punishable under Sections 296(b), 132, 123 of BNS r/w 6(b), 24(1) of the Cigarette and other Tobacco Products Act, 2003 is on board for consideration.

2. The incarceration of the petitioner/A1 being from 14.11.2024 pleading innocence on the part of the petitioner and false implication in the case, the learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner has been implicated in this case, since he has some previous cases. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner/A1 along with other accused indulged in selling the banned tobacco products to the public and from them, 500 grams of mava and other banned tobacco products were seized. He further submits that four previous cases of similar nature is pending against the petitioner, therefore, if the petitioner is released on bail, there is a possibility of him absconding and not available for further investigation. https://www.mhc.tn.gov.in/judis

Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and taking note of the fact that the petitioner was arrested very recently and also considering the antecedents of the petitioner, this court is not inclined to grant bail to the petitioner.
