ORDER

This Writ Petition has been filed by the petitioner seeking for a Writ of Certiorarified Mandamus, to call for the records pertaining to the issuance of the email dated 06.07.2023 on the file of the 4th respondent herein and quash the same and direct the respondents to consider the load port IIA report submitted by the petitioner on 27.05.2023 and release 100% of the payment for the 1st shipment delivered on 31.05.2023.

2. When the matter was taken up for hearing today, the learned counsel appearing on both sides produced a joint memo dated Page No.2 of 6

03.11.2025, wherein the parties have expressed their willingness to get their disputes resolved before an arbitrator. The parties have also accepted the name of Hon'ble Mr. Justice D. Krishna Kumar, Former Chief Justice, High Court of Manipur to act as an arbitrator.

3. Accordingly, in view of the joint memo dated 03.11.2025 filed by the parties and also their willingness to resolve the dispute before an arbitrator, this Court is inclined to pass the following orders :- (i) Hon'ble Mr. Justice D. Krishna Kumar, Former Chief Justice, High Court of Manipur, who is having address at No.13/7, 12th East Street, Kamarajar Nagar, Thiruvanmiyur, Chennai - 600 041 (Mobile No.94455 00225) is appointed as the sole Arbitrator to resolve the dispute between the parties;

(ii) the Arbitrator is requested to conclude the arbitration proceedings as expeditiously as possible; (iii) the Arbitrator may fix his remuneration and the same shall be borne by the parties equally. Page No.3 of 6

4. The Writ Petition is disposed of in the above terms. No costs.
