ORDER

This writ petition has been filed challenging the impugned proceedings of the 3rd respondent dated 18.04.2017 and for a consequential direction to the 3rd respondent to disconnect the service connection given in favour of respondents 4 to 8. 2.

Heard Mr.M.D.Illayaraja,learned counsel for the petitioner and Mr.L.Jai Venkatesh, learned Standing counsel for respondents 1 to 3 and Mr.R.Sudhakar Raj, learned counsel for 4th respondent.

On carefully considering the submissions made on either side and the materials available on record, it is seen that a substantive suit has been filed by the petitioner in OS No.244 of 2016 against the private respondents and the same is pending. The petitioner is claiming right and title over the suit property and the claim of the petitioner is that the private respondents, who have no

right over the property have managed to get the service connection. 4.

It is not necessary for this Court to go into the interse dispute between the petitioner and the private respondents. It is seen that the suit is pending from the year 2016 and the final decision in this suit will substantially give clarity on the rights of the respective parties. Therefore, without going into the merits of the case, there shall be a direction to the Sub Court, Namakkal, to dispose of the suit in OS No.244 of 2016 within a period of three months from the date of receipt of a copy of this order. Depending upon the final result in the suit, it is left open to the petitioner to work out his remedy.

This writ petition is disposed of in the above terms. No costs. Consequently, the connected miscellaneous petition is closed.
