Respondents Prayer :- Writ Petitions filed under the Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 3rd Respondent herein to register the Deed of Rectification of Settlement deed dated 21.11.2023 presented before the SRO Sunguvar Chathiram /3rd Respondent herein the Rectification Deed of Which was originally executed by the 1st Petitioner in the name of the 2nd petitioner the same registered as Doc.No.13142/2006 dated 31.07.2006 before the SRO, Sriperumbudur / 2nd Respondent herein by also considering the representation of the petitioner dated 21.11.2023.

ORDER

By consent of both parties, this writ petition is taken up for final disposal.

2. This Writ Petition has been filed to direct the 3rd Respondent to register the Deed of Rectification of Settlement deed dated 21.11.2023 which was originally executed by the 1st Petitioner in the name of the 2nd petitioner, the same was registered as Doc.No.13142/2006 dated 31.07.2006 before the 2nd Respondent by also considering the representation of the petitioner dated 21.11.2023.

3. It is the grievance of the petitioner that when he presented the rectification deed for registration before the third respondent to rectify the survey number in the settlement deed dated 31.07.2006 registered before the second respondent, the same has been refused to be received. Hence, 2/6

this writ petition.

4. Counter has been filed by the third respondent, wherein, paragraph 6 reads as follows:

" ...6. It is further submitted that Thirumenikuppam Village falls under the jurisdiction of the 3rd respondent. The petitioner has sent a representation to the 3rd respondent office on 21.11.2023, to which the 3rd respondent has sent a reply communication to the petitioners on 22.11.2023 by stating that if the petitioner obtain a token from online portal of Tamil Nadu Registration Department and if they have paid necessary stamp duty and registration through online mode and presented for registration along with necessary revenue documents, the same will be considered under the Rules and Registration contemplated under the Registration Act, 1908."

5. Heard both sides and perused the materials placed on record. 3/6

6. In view of the above, the petitioner shall present the rectification deed within a period of one week from the date of receipt of a copy of this order and the third respondent/Sub-Registrar is directed to register and release the same as per law within a period of 15 days thereafter.

7. With the above directions, this writ petition stand disposed of. No costs.
