ORDER
On 15.12.2023, a common final order came to be passed in WP.Nos.34491 & 34496 of 2023. However, today when the matter came up under the caption 'for being mentioned', it was brought to the notice of this Court that both the Writ Petitions are not connected with each other.
2. Accordingly, the common order dated 15.12.2023 passed in WP.Nos.34491 & 34496 of 2023, is hereby recalled and a fresh final order is passed in WP.No.34496 of 2023 today.
3. With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
4. In the present Writ Petition, the petitioner has challenged the order of punishment whereby, he was reduced to a lower Rank as Executive Engineer. As against the order of punishment, he had also 2/5
preferred an appeal on 12.06.2020 before the first respondent herein, which is said to be pending.
5. Though the petitioner herein has challenged the final order dated 21.04.2020 passed in the disciplinary proceedings, the learned counsel for the petitioner submitted that the petitioner had preferred an appeal to the first respondent on 12.06.2020 against the final order and that he would be satisfied if the first respondent herein is directed to dispose of the appeal, within a stipulated time.
6. In consideration of the submission made by the learned counsel for the petitioner, no interference is required in the prayer sought for in this Writ Petition. However, there shall be a direction to the first respondent herein, to dispose of the petitioner's appeal dated 12.06.2020, within a period of eight (8) weeks from the date of receipt of a copy of this order, if not already disposed of.
7. With the above direction, the Writ Petition stands disposed of. No costs.
