O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Contempt Petition has been filed seeking to punish the respondents for their wilful disobedience of the orders of this Court dated 02.04.2019 in W.P.No.18659 of 2018.

2. This Court passed an order recording the statement of the respondents in paragraph No.4, which reads as under:-

4. since the 4th respondent has categorically stated that action is being taken by the authorities for removing the encroachment, no further direction need be given in these Writ Petitions. Recording the averments stated in the status report filed by the 4th respondent, the Writ Petitions are disposed of. No costs. Consequently, the connected Miscellaneous Petitions are closed.

3. The contention of the petitioners that there is encroachment is not fully correct. The learned Special Government Pleader would submit that assignment was granted to the persons under occupation. Certain assessees violated the conditions stipulated in the assignment order. Thus, the assignment patta came to be cancelled. One of the assessees filed W.P.No.29807 of 2024. The learned Single Judge allowed the Writ Petition on 20.11.2024 to restore the assessment patta.

4. Even otherwise it is not the encroachment, it is the case where assessees violated the conditions and the Government has already cancelled the assignment in respect of other violators. That being so, the Government has to resume the Government property from the assesses who have violated the assignment conditions.

5. This Court does not find any wilful disobedience of the orders of this Court. Consequently, the Contempt Petition stands dismissed. (S.M.S., J.) (C.K.,J.) 19.02.2026 dsa Internet :Yes/No Index :Yes/No 3/4
