ORDER

This Suo Motu case is dealt with in an extraordinary manner by this Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. The case is registered for alleged offence under Section 7A(1) Read with Section 41 Rule 61D read with Section 21(2) Rule 53 Schedule VIII Item 3 and 11, Section 41 Rule 61D & Section 13 (1) (2) Rule 17A of The Factories Act, 1948 (Amended Act 1987) and The Tamil Nadu Factories Rules, 1950. The incident occurred on 25.01.2024. The proposed accused is admitting the case. It is also stated that the compensation had already been paid to the injured workers and their medical expenses were also taken care of Page No.1 of 3

by the Management. Further, it is stated that on behalf of the management, the Manager is proposed as accused.

3. Considering the overall facts and circumstances of the case, since the offence is admitted and that he has now pleaded guilty, this Court is of the view that a sum of Rs.25,000/- is imposed as fine for the alleged offence stated supra, shall be imposed. The fine amount shall be paid by the accused on the next date of hearing before the Trial Court.

4. Accordingly, the case in CC.No.234 of 2024 on the file of Chief Judicial Magistrate Court, Chengalpattu, stands quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
