ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 13.04.2019, the accused drove the vehicle and caused injuries. The case was registered in Crime No.217 of 2019 for the alleged offences under Sections 279 and 338 of Indian Penal Code (IPC), 1860 and Section 181(3) of Motor Vehicles Act, 1988. It is submitted that the defacto complainant is not residing at the given address and remains untraceable till date. It is also not known whether any claim petition has been filed in connection with the incident.

3. When the matter was called, the accused was present before the Court and pleaded guilty.

4. Considering the overall nature of the accident, the fact that the accused has been facing the case for a long time and that he has now pleaded guilty, this Court is of the view that a penalty of fine of Rs.200/- for the offence under Section 279 of IPC and Rs.300/- for the offence under Section 337 of IPC shall be imposed. The fine amount shall be paid by the accused on the next date of hearing before the Trial Court.

5. Accordingly, the case in S.T.C.No.1294 of 2019 on the file of Judicial Magistrate Court No. I, Tambaram Taluk, Chengalpattu shall stand quashed and this Suo Motu Transfer Case stand disposed of. It is made clear that if any claim petition is filed at a later stage, the present order shall not affect such proceedings.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
