ORDER

1. There are three applications filed by the applicant. A.No.5899 of 2025 is filed to condone the delay of 899 days in representing the above suit. A.No.5900 of 2025 is filed to refund the court fee amount of Rs.3,26,055/- paid in the above suit. A.No.5901 of 2025 is filed to condone the defective representation. Heard the counsel for applicant. The reason stated for the delay in re-presentation is that subsequent to the filing of the suit, the respondents/defendants came to know about the legal proceedings and proposed a negotiation to resolve the dispute. Subsequently, the applicant and the respondents engaged in prolonged negotiation and lengthy discussion to reach a mutually agreeable settlement to resolve the dispute amicably and now that they have reached a settlement outside the court. Hence, these applications to condone the delay in representation, defective representation and refund of court fee.

2. The reasons stated in the accompanying affidavit sounds satisfied and considering the fact that the parties have reached at an amicable settlement out of the court, this court is inclined to allow all these applications.
