ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Section 9 and 11 of Prohibition of Child Marriage Act, 2006. The victim has attained majority and submits that she is already living with her husband as a family. She does not wish to continue the case.

3. Normally, in matters of this nature, the Court does not rely only on the version of the prosecutrix. However, considering the overall facts, that the victim has attained majority, is living with her husband and that the accused (her Parents) have been facing trial since 2024, this Court is of the view that this is a fit case for exercise of its jurisdiction under Section 482 of Code of Criminal Procedure, 1973.

4. Accordingly, the case in C.C.No.81 of 2024 on the file of the Judicial Magistrate Court, Harur Taluk, Dharmapuri shall stand quashed and this Suo Motu Transfer Case stand disposed of.

22.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
