Learned counsel for the petitioner would submit that the petitioner may be permitted to file an appeal as against the order of assessment under Section 147 read with 144B as well as the order of penalty under Section 271(1)(c) of the Income Tax Act. The learned counsel has also made an endorsement to that effect.

2. In view of the above, the writ petition stands closed, with liberty as prayed for. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
