The main writ petition is itself listed on 04.01.2024 and the following order was passed on 29.11.2023 when the writ petition had came up for hearing:- "Mr.Karthik, learned counsel, for Mr.Deivanandan, learned counsel, undertakes to file vakalat for R3. Upon receipt of which, description of R3 may be deleted.
2. Service is complete on R1 and R2 and the names having been printed in causelist, there is no appearance on their behalf.
3. List on 04.01.2024. Counter on all respondents by then.
4. The respondents will produce copy the answer sheets of the petitioner for the examinations (subject code 5260635626064 - Pathology Paper I and Paper II) written in February, 2023, on the next date of hearing."

This application seeks a direction to R1 and R2 to receive payment of fees which would enable the petitioner to write the examinations to be held in January.

The basis of the petition is the assumption that the petitioner will be successful in writ petition and if so should be entitled to participate in the forthcoming examinations in January. Hence, this Court does not find any harm in accepting the interim direction as if the petitioner, at the end of the day, were to be found to be unsuccessful in writ petition, the fees could well be returned. https://www.mhc.tn.gov.in/judis

Hence, let the petitioner's fees be accepted, subject to the result of the writ petition.
