O R D E R

The writ petition is filed seeking a direction to 1st respondent to issue passport to the petitioner based on her application in file No. 24-1013860345.

2. The petitioner applied for issue of passport before the 1st respondent. The petitioner received a mail from the 1st respondent informing her that her application was put on hold due to pendency of the case. Therefore, the petitioner has come before this Court seeking above mentioned direction.

3. Heard the arguments of the learned counsel for the petitioner and Mr.J.Madanagopal Roa, learned Senior Panel Counsel for the 1st respondent and Mr.L.Baskaran, learned Government Advocate (Crl.side) for the 2nd respondent.

The learned Government Advocate (Crl.side) for the 2nd respondent filed a status report wherein it is stated that a criminal case is pending against the petitioner under Sections 109, 294(b), 352, 506(2), 494 of IPC read with Section 4 of Tamil Nadu Prohibition of Harassment of Women in C.C.No.343 of 2023 on the file of Judicial Magistrate No.II, Kumbakonam. 2/5

Since the criminal case is pending against the petitioner, she is directed to file an application before the concerned court seeking permission to visit abroad within a period of two weeks from the date of receipt of copy of this order. If any such application is filed by the petitioner, the same shall be considered and final orders shall be passed by the concerned Criminal Court within a period of four weeks from the date of filing of such application by the petitioner. If permission is granted by the concerned criminal court, the certified copy of the same shall be produced before the 1st respondent and on production of the same, the 1st respondent shall process the application filed by the petitioner for issue of passport and pass final orders on merits within a period of four weeks from the date of receipt of copy of the order passed by the Criminal Court.

6. With the above directions, this writ petition stands disposed of. No costs.
