ORDER

This petition has been filed to clarify the order passed by this Court in W.P.No.23266 of 2024 dated 23.09.2024.

2. The learned Senior Counsel appearing for the petitioner would submit that in the order passed by this Court in W.P.No.23266 of 2024 dated 23.9.2024, in the last paragraph, viz, Paragraph No.8, among other things, it has been stated that "the fifth and sixth respondents are directed to handover the vacant possession of the subject property situated at Door No.11, 2nd Cross Street, Collectorate Colony, Aminjikarai, chennai to the petitioners forthwith on condition that the petitioners shall handover the original settlement deed, which was already executed in favour of the fifth respondent in respect of the Tiruvarur property forthwith", however, on instructions from the petitioners, he would contend that the petitioners never executed any settlement deed in respect of the Tiruvarur property, thereby pleaded that the petitioners were not able to comply with the directions issued by this Court on 23.09.2024, thereby pleaded for a clarification with respect to that portion alone.

Acceding to the request of the learned senior counsel appearing for the petitioners, the condition imposed by this Court by an order dated 23.09.2024 is deleted and the respondents 5 and 6 are directed to handover the possession of the subject property at Door No.11, 2nd Cross Street, Collectorate Colony, Aminjikarai, chennai to the petitioners forthwith.

4. In view of the above, the Paragraph No.8 of the order dated 23.09.2024 shall be read as follows:- "8.In view of the above, the order passed by the first and second respondents cannot be sustained and it is liable to be quashed and the complaint lodged by the petitioners is allowed. Accordingly, the order passed by the first and second respondents are hereby quashed. The fifth and sixth respondents are directed to handover the vacant possession of the subject property situated at Door No.11, 2nd Cross Street, Collectorate Colony, Aminjikarai, Chennai, to the petitioners forthwith." This petition is ordered accordingly.
