ORDER

This writ petition has been filed for issue of Writ of Mandamus directing the second respondent to deal with the appeal filed by the petitioner on 02.11.2024 and pass orders within the time frame fixed by this Court.

2. Heard Mr.I.Kowser Nissar, learned counsel appearing for the petitioner and Mr.P.Ganesan, learned Government Advocate appearing for respondents 1 to 3.

3. The case of the petitioner is that the subject property belonged to the petitioner's grandfather. He died on 03.10.1965 leaving behind six legal heirs. The grievance of the petitioner is that, the patta was issued in the name of fourth and fifth respondents who did not have any title over the property. Hence, the petitioner submitted a representation to the third respondent to rectify the error. However, the third respondent rejected the application vide proceedings dated 24.09.2024. Aggrieved by the order passed by the third respondent, an appeal was filed before the first respondent on 02.11.2024 and the same has been forwarded to the second respondent. The second respondent through proceedings dated 21.11.2024 had called upon the third respondent to submit all 2/4

records pertaining to the petitioner's case. Thereafter, the appeal was not taken up for hearing by the second respondent and it is under these circumstances, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to deal with the appeal filed by the petitioner on 02.11.2024 on its own merits and in accordance with law, after affording opportunity to respondents 4 and 5, and pass final orders within a period of six weeks from the date of receipt of a copy of this order.
