ORDER

The relief sought for in this writ petition is to direct the first respondent to pass order and dispose the petitioner's appeal dated 10.03.2025 preferred against the Impugned Order in Na.Ka.No.A1/1241/2024 dated 25.02.2025 on the file of the second respondent and dispose the same.

2. Mrs.S.Indhu Bala, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the land in Survey Nos.534/1A, 534/1B & 534/1C to an extend of 3.62 acres and Survey No.534/2 to an extend of 3.78 acres situated in Koovagam Village, Ulundoorpettai Taluk, Villupuram District was conditionally assigned in favour of the petitioner's father Mr.A.Kuppamuthu and his brother A.Ayyamuthu, by 2/6

virtue of Revenue Board Standing Orders. The said lands shall not be alienated to other communities, however the lands were occupied by other Community members, which is a clear violation of R.S.O 15(41)(4). Hence, the petitioner as a legal heir of original assignee made representation to the respondents 2 & 3 on 26.06.2019 and no order was passed. Therefore, the petitioner filed a writ petition in W.P.No.1999 of 2020 and this Court passed an order on 07.06.2024, directed the second respondent to pass an order on the petitioner's representation in accordance with law, within a period of six weeks. Accordingly, the second respondent passed an impugned order in Na.Ka.No.A1/1241/2024 dated 25.02.2025 negativated the request of the petitioner giving liberty to prefer an Appeal before the first respondent within a period of 60 days. Hence, the petitioner has preferred an appeal on 10.03.2025, but the same was not considered, till date. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this 3/6

Court issues direction to the first respondent to dispose of the petitioner's appeal dated 25.02.2025.

5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioner's appeal dated 25.02.2025 would be considered and appropriate orders passed within a time frame to be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the submission made by the learned counsel on either side, this Court without going into the merits of the case, directs the first respondent to consider and dispose of the petitioner's appeal dated 25.02.2025, after giving due notice and opportunity of personal hearing to the petitioner as well as aggrieved persons, if any, within a period of eight weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition is disposed of. No 4/6

costs.
